Wozzo: Website and Automation Service Terms

Version: draft 2, 3 November 2026 (updated after the AI review)

Service provider: Garason Dunston Griesel trading as Wozzo ("we", "us")

Address (also for legal documents): 73 Underwood Road, Pinetown, 3610 · Email: hello@wozzo.co.za · Phone/WhatsApp: 078 435 3299

Website: wozzo.co.za

Registration number: none (sole proprietor) · VAT number: not VAT registered

These terms apply when you ("the client") take up our monthly website and automation plan.

How you accept them: before you pay, our sign-up page shows these terms and a short summary of the important points, and you tick "I accept". We send you a copy by email or WhatsApp. Please read clauses 5.2 and 11 carefully. They limit what we're responsible for and make you responsible for some claims.

Who you are: when you sign up, you give us your business's name, legal form (sole trader, company or other), registration number (if any), and the name of the person accepting. That person confirms they may sign for the business.

1. The free preview

1.1 If you ask for one, we build you a free preview website before you sign up. It costs nothing and you are under no obligation to buy anything.

1.2 The preview link stays online for 7 days after we send it, then shows a "this preview has ended" page.

1.3 The preview is built from public information about your business and anything you send us. It may contain mistakes. Please check it, and tell us what to change before it goes live.

2. What the monthly plan includes

For R1 499 per month (or the founding price in clause 4), we provide:

2.1 Your website, hosted by us on a .co.za domain registered in your name (clause 7).

2.2 Instant lead alerts: when someone fills in the form on your website, you get an SMS straight away, and they get an automatic SMS confirming that you received their message. The automatic SMS only confirms the message. It never contains offers or promotions.

2.3 Google review requests: a private page where you enter a customer's name and cellphone number after a job, and we send them one SMS asking for a Google review.

2.4 A monthly report: website enquiries, messages sent, review requests and your Google rating.

2.5 Small edits: changes to text, photos, prices, opening hours and contact details, usually within 2 business days. New pages, redesigns and new features are quoted separately before any work starts.

2.6 SMS fair use: up to 200 SMS a month across alerts, auto-replies and review requests. One SMS is up to 160 characters; a longer message counts as 2 or more. We warn you by SMS or WhatsApp at 150 and at 200. Above 200 we charge R0.50 per SMS, by a separate payment link at the end of the month. If you'd rather not pay extra, tell us and we'll pause review requests until next month. Lead alerts and auto-replies keep running. If your form is abused (spam), we may pause the SMS automations, and we'll tell you the same day.

2.7 Optional once-off: setting up or claiming your Google Business Profile, R499.

2.8 Add-ons are offered separately, at prices we agree in writing, as they become available.

2.9 Going live: we put your website live within 3 business days after your first payment, as long as we have what we need from you.

3. Price and payment

3.1 You pay monthly in advance through PayFast, by card or another method PayFast offers. Your plan starts on the day your first payment clears.

3.2 We are not VAT registered, so no VAT is charged. If we register for VAT, we'll give you 30 days' written notice of the new price, and you may cancel before it applies.

3.3 We may change the plan price with at least 30 days' written notice. You may cancel before the new price takes effect. This does not apply to a founding price during its 12 months.

3.4 Late payment: if a payment fails we will let you know. If it isn't paid within 7 days, we may pause the service (clause 10) until it is.

4. Founding client price

4.1 Our first 5 clients pay R999 per month for their first 12 months. This locks the price only. It isn't a minimum term, and you can still cancel at any time (clause 9). In return, you agree to:

You can ask us to stop using your testimonial or website at any time, and we'll remove them from our website and social media within 7 days. If you do this within the 12 months, the normal price applies from your next payment.

The founding price is not linked to a Google review. We may ask for an honest Google review later, but it is never a condition of any price.

4.2 After 12 months the plan moves to the normal price. We will remind you at least 30 days before that happens.

5. What we need from you

5.1 Information that is accurate and up to date: services, areas, hours and contact details. You are responsible for checking the content of your website before it goes live. We use AI tools to help write it, and we check it, but you know your business best.

5.2 Only send us logos, photos and text that you own or have permission to use. If someone claims against us because of material you supplied, you must cover our reasonable costs of that claim, unless the claim was caused by something we did.

5.3 Use the review and SMS tools lawfully (clause 8).

5.4 Reply to our questions within a reasonable time. We are not responsible for delays caused by waiting for you.

6. Ownership

6.1 Your content stays yours: your business name, logo, the photos you supplied, and your customers' details. Website text we write for you (with or without AI tools) becomes yours once you've paid for the month in which it was published.

6.2 The website design, layout and code stay ours. While you subscribe, you may use them for your business.

6.3 If you cancel, you may buy the website files (design and code) for a once-off R2 500. After 24 paid months there's no charge. Whether or not you buy them, if you ask within 30 days of the end, we send you free of charge your text, your photos and a spreadsheet of your customers' enquiries. Stock photos we licensed can't be passed on, and we'll tell you which ones they are.

7. Your domain name

7.1 We register your .co.za domain in your name. You are the registrant and legal owner. We act as the administrative and technical contact so we can manage it for you.

7.2 The yearly domain fee is included in your plan while you subscribe. We list your email address as the registrant's, so official domain notices reach you.

7.3 If you cancel, the domain stays yours. Within 2 business days of your request, we give you the transfer (auth) code and help you move it. We'll also tell you the next renewal date. After you leave, renewing it is up to you.

8. Lead alerts, review requests and your customers' information (POPIA)

8.1 For your customers' information (names, numbers and messages from your website form, and numbers you enter for review requests), you are the "responsible party" and we are your "operator" under the Protection of Personal Information Act 4 of 2013 (POPIA). Our Operator Agreement (shown on the sign-up page, accepted with the same tick, and forming part of these terms) sets out how we look after that information.

8.2 Review requests may only go to people who bought from you in the last 6 months, and whom you told at the time that you might send one SMS asking for a review. Never use bought, borrowed or scraped numbers, or the number of anyone who said no. Each request goes out in your business's name, says how to reach you, and ends with "Reply STOP to opt out". Once someone opts out, we never message them again for your business.

8.3 Review requests are sent only during the hours allowed for direct marketing: weekdays 08:00–20:00 and Saturdays 09:00–13:00, not on Sundays or public holidays. Requests made outside those hours wait until the next allowed time. We record the time each SMS is sent.

8.4 Ask every customer, not only the happy ones. Google does not allow "review gating", and it may remove reviews if you only ask selected customers. Never offer anything in exchange for a review.

8.5 Your website shows a privacy notice that we prepare from your details. Please tell us if anything in it is wrong.

9. Cancelling

9.1 No contract: you may cancel at any time by telling us in writing (WhatsApp or email). The service runs until the end of the month you have already paid for, and we don't charge you again. We cancel your PayFast subscription within 1 business day of your notice.

9.2 Cooling-off: you may cancel within 7 days after your first payment, for any reason, by telling us in writing. We refund everything you paid within 15 business days and switch the website off. We only start the Google Business Profile setup after the 7 days, unless you ask us in writing to start sooner.

9.3 When the service ends:

9.4 We may end the service with 30 days' written notice, or straight away if you use it unlawfully or abuse it (for example, spam).

10. Pausing for non-payment

10.1 If a payment is more than 7 days late, we may pause the service. Your website then shows a simple "temporarily unavailable" page with your phone number, and the automations stop.

10.2 Everything is switched back on as soon as you pay. Nothing is deleted while the service is paused.

11. Availability and liability

Important: please read this clause. It limits what we're responsible for.

11.1 We use reputable hosting and SMS providers, and we aim to keep everything running. We can't guarantee there will never be an interruption, for example during provider outages or load-shedding at their end.

11.2 We are not liable for indirect or consequential loss, such as lost profit or lost leads.

11.3 Otherwise, our total liability in any 12-month period is limited to the fees you paid us in that period.

11.4 Clauses 11.2 and 11.3 don't apply to loss caused by our gross negligence, fraud or deliberate wrongdoing, or where the law doesn't allow a limit. Nothing in these terms takes away your rights under the Consumer Protection Act 68 of 2008, where it applies to you.

12. Changes to these terms

We may update these terms with 30 days' written notice. If you don't agree, you may cancel before the change takes effect.

13. General

13.1 These terms, the Operator Agreement and any written quotes we agree make up the whole agreement.

13.2 South African law applies.

13.3 If there's a dispute, we'll first try to sort it out by talking. You may also approach the Consumer Goods and Services Ombud or the National Consumer Commission where applicable, and the Information Regulator for privacy complaints.

13.4 Notices may be sent by email or WhatsApp to the details each of us last gave the other. Legal documents must be delivered to us at 73 Underwood Road, Pinetown, 3610, and to you at the address you gave on sign-up.

13.5 If any clause can't be enforced, the rest still applies.

Operator Agreement (POPIA sections 20 and 21)

This forms part of the Website and Automation Service Terms. The client accepts it by ticking "I accept" on our sign-up page before paying. We keep a record of the date, time and name of the person who accepted.

Version: draft 2, 3 November 2026 (updated after the AI review)

Between:

1. Why this agreement exists

1.1 When the Operator runs the client's website and automations, it handles personal information about the client's customers on the client's behalf. Under the Protection of Personal Information Act 4 of 2013 (POPIA):

1.2 Section 21 of POPIA requires a written contract between them. This is that contract.

2. Information covered

WhoseWhatWhere it comes from
People who contact the client through the websitename, phone number, email, their messagethe website enquiry form
The client's customersfirst name, cellphone numberentered by the client on the review-request page
Anyone who replies to an SMStheir number and reply, including "STOP"the SMS provider
Everyone abovedelivery records and countsthe Operator's systems
Visitors to the client's websitebasic technical logs, such as IP addressesthe hosting provider

3. What the Operator may use it for

3.1 Only to provide the service: passing enquiries to the client, sending the client's instant alerts, the customer's auto-reply, review requests and opt-out handling, and preparing the client's monthly report.

3.2 The Operator will not use this information for its own marketing, sell it, or share it with anyone except the sub-operators in clause 6. It does not send the client's customers' information to AI tools.

3.3 The Operator processes it only with the client's knowledge and authorisation (section 20), and treats it as confidential. It doesn't disclose it unless the law requires it.

4. Security (section 19)

The Operator has identified the main risks (someone getting into its accounts, a lost phone or laptop, a provider being hacked) and keeps these measures in place:

5. Data breaches (section 22)

5.1 If the Operator or one of its service providers has reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, the Operator will tell the client immediately, and at the latest within 24 hours of finding out. It will explain what happened, what information and how many people were affected, and what it is doing about it, and will keep the client updated.

5.2 The client, as responsible party, must notify the Information Regulator (through the Regulator's online eServices portal) and the affected people, as section 22 requires. The Operator will draft both notices and help the client submit them.

5.3 The Operator keeps a written record of every incident, however small.

6. Sub-operators and information leaving South Africa (section 72)

6.1 The client agrees that the Operator may use these service providers ("sub-operators"):

ProviderWhat it doesWhere the data is
Supabasedatabase and server functionsLondon, United Kingdom (Supabase is a US company)
Netlifyhosts the website and formUSA and worldwide servers
BulkSMSsends and receives SMSto be confirmed with BulkSMS
PayFastclient billing only, no customer dataSouth Africa

6.2 The Operator has a written agreement with each sub-operator (usually its data processing agreement) that requires it to keep the information secure and confidential and to use it only to provide its service. The Operator remains responsible to the client for its sub-operators.

6.3 Some providers store or access information outside South Africa. Under section 72 of POPIA, the Operator sends information outside South Africa only to providers that are bound by a law or a binding agreement giving protection substantially similar to POPIA: for the United Kingdom, its data protection law; for the United States and elsewhere, the provider's data processing agreement. For website enquiries, the transfer is also necessary to deal with the enquiry the customer made.

6.4 The Operator will give the client at least 14 days' notice before adding or changing a provider that receives the client's customers' information. If the client objects, it may cancel the service before the change.

7. Requests from customers

If a customer asks to see, correct or delete their information, or objects to being contacted, the Operator passes the request to the client within 2 business days and helps the client reply within 30 days. Requests are free for the customer. Any "STOP" or opt-out is actioned immediately and automatically.

8. How long information is kept

8.1 SMS message text is cleared after 12 months; counts are kept for reporting.

8.2 Enquiries are kept for 24 months and then deleted automatically, unless the client asks for a different period.

8.3 When the service ends: the client's customers' information is deleted 30 days after the end, unless the client asks for a copy first (free, as a spreadsheet). Backup copies are overwritten within 7 days after that.

8.4 Opt-outs: the client authorises the Operator to keep, after the service ends, a scrambled (hashed) copy of the numbers that opted out of the client's messages, linked only to the client's account. It is used only to make sure those people are never messaged again for the client, and is deleted after 3 years. It is kept as securely as any other personal information.

9. The client's responsibilities

The client confirms that:

10. Term

This agreement lasts as long as the service, and its confidentiality and deletion terms continue after it ends.

11. Responsibility for breaches

Each party is responsible for its own breaches of POPIA. The limits in clause 11 of the service terms apply to this agreement too, except for gross negligence or deliberate wrongdoing.
